Board of Zoning Appeals (BZA) Meeting

The Blacksburg Board of Zoning Appeals will meet on Wednesday, December 14, 2022 at 3:00 p.m. in the large conference room of the Blacksburg Motor Company Building, 400 South Main Street, Blacksburg, Virginia, to hear the following two cases:

BZA Case #22-0002 – Appeal of a determination concerning an over occupancy violation in the R-4 Low Density Residential Zoning District at 611 Montgomery Street N.E. (Tax Map No. 226- 8SEC 4 17-1*). Seeds Properties II LLC – Ty Hopkins (property owner) is appealing Zoning Violation #22-019 for exceeding the maximum allowed occupancy at 611 Montgomery Street N.E. in the R-4 Transitional Residential Zoning District. Zoning Ordinance, Section 3042 (e): The maximum dwelling unit occupancy shall be a family plus two (2) persons unrelated to the family; or no more than three (3) unrelated person. For a detached single-family dwelling with a nonconforming accessory apartment, or an accessory apartment as allowed through the accessory apartment permit program, occupancy shall be figured cumulatively including both the single-family dwelling and the accessory apartment for a total not to exceed three (3) unrelated persons.

BZA Case #22-0003 – Request for a front yard setback variance in the OTR- Old Town Residential District at 109-115 Wharton Street N.E. (Tax Map No. 257- A 25). Kevin Gilbarte (property owner) began construction of two (2) porch covers at 109-115 Wharton Street N.E. without an approved building permit and in violation of the minimum 20’ front yard setback. Proposed porch covers are located approximately 17 feet and 3 inches from the front yard property line. Zoning Ordinance, Section 3062 (c) Minimum setback requirement: (1) Front yard: Twenty (20) feet.

Persons affected by either of these two cases may appear and present their views at the public hearing. Persons may also submit public comments to planning staff by e-mail. After the hearing for the case, the Board will consider making a decision on the appeal.
